AutoServe Terms of Service

1. Acceptance of Terms

By using the AutoServe platform — whether as a registered user or a guest completing a booking — you agree to these Terms of Service and our Privacy Policy in their entirety. If you do not agree, do not use AutoServe.

2. Description of Service

AutoServe provides an online platform that allows users to discover, compare, and book vehicle service appointments at participating dealerships and service providers. AutoServe is a booking facilitator, not a service provider. Actual vehicle services are performed by independent third-party dealerships and service centers.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4. Guest Bookings

Users who complete bookings without creating an account ("guest users") are bound by these Terms of Service and the Privacy Policy in effect at the time of their booking, including all provisions relating to data ownership, data commercialization, and AutoServe's rights to collected data.

5. Booking and Cancellations

• Bookings made through AutoServe are subject to confirmation by the participating service provider
• AutoServe is not responsible for scheduling errors, service delays, or cancellations by service providers
• Cancellation and rescheduling policies are determined by the individual service provider

6. Data Ownership and Commercialization

All data generated through your use of AutoServe — including data submitted by guest users — is owned by AutoServe. This includes your username, full name, email address, phone number, zip code, vehicle information (including year, make, model, mileage, service history, and images), booking records (including confirmation numbers, service status, appointment dates, and service center data), usage data, and any inferred or derived data. AutoServe does not collect financial or payment information. As owner of all such data, AutoServe has the unconditional right to use, store, reproduce, modify, distribute, sell, license, and otherwise commercialize such data in any form, for any lawful purpose, without restriction and without compensation to you. These rights survive termination of your use of the platform, account deletion, and opt-out requests with respect to data collected prior to such events. For full detail, see our Privacy Policy.

7. User Conduct

You agree not to:

• Provide false vehicle or contact information
• Use the platform for any unlawful purpose
• Attempt to access, scrape, or reverse-engineer any part of the AutoServe platform
• Interfere with the operation of the platform or other users' access to it

8. Third-Party Service Providers

AutoServe is not a party to any service agreement between you and a dealership or service center. We are not liable for the quality, safety, timeliness, or outcome of any vehicle service booked through our platform. Disputes regarding service quality must be resolved directly with the service provider.

9. Disclaimer of Warranties

AutoServe is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be error-free, uninterrupted, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AutoServe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of or inability to use the platform, even if advised of the possibility of such damages. AutoServe's total liability to you for any claim shall not exceed the amount you paid to AutoServe in the twelve months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless AutoServe, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding individual arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against AutoServe.

13. Modifications

We may update these Terms at any time and for any reason. Material changes will be communicated via email or in-platform notice to registered users. Guest users are bound by the version in effect at the time of their booking. Continued use of AutoServe constitutes acceptance of the revised Terms.

14. Termination

AutoServe reserves the right to suspend or terminate your account at any time, with or without notice, for any reason at our sole discretion. Termination does not affect AutoServe's rights to data collected prior to termination.
